Status<\/strong><\/h2>\n\n\n\n<p><strong>Doninu (Malta) International is not registered with the OCVO<\/strong> (Office of the Commissioner for Voluntary Organisations), and <strong>is not legally Organisations Act, Laws of Malta<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p>This law states that <strong>groups which do not collect or handle money and do not operate commercially are not obliged to register<\/strong>, provided they act ethically and transparently.<\/p>\n\n\n\n<p>We strictly follow this legal framework.<br>Our operation is <strong>100% legal, independent, and based on love in International and Its Rightful Status Under Maltese, EU, and International Law<\/strong><\/h1>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p><strong>1. Introduction<\/strong><\/p>\n\n\n\n<p>Doninu (Malta) International is a humanitarian, non-commercial, volunteer-led initiative that operates in Malta and supports vulnerable individuals, families, and communities without handling money, collecting funds, or accepting government financial support. The organisation operates solely through in-kind donations and voluntary action. It is not registered with the Office of the Commissioner for Voluntary Organisations (CVO), and asserts its right to operate independently and lawfully under Maltese, European, and international legal frameworks.<\/p>\n\n\n\n<p>This report outlines the legal grounds that protect and legitimise the work of Doninu (Malta) International.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p><strong>2. Nature and Scope of Doninu (Malta) International<\/strong><\/p>\n\n\n\n<p>Doninu:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Does not collect or manage money<\/li>\n\n\n\n<li>Does not accept grants from government or institutions<\/li>\n\n\n\n<li>Does not conduct fundraising for itself<\/li>\n\n\n\n<li>Does not engage in commerce or offer paid services<\/li>\n\n\n\n<li>Operates fully through volunteers<\/li>\n\n\n\n<li>Provides food, second-hand goods, emotional support, and educational materials to those in need<\/li>\n\n\n\n<li>Refers vulnerable persons to official authorities<\/li>\n\n\n\n<li>Promotes inclusion, defends human rights, and supports other NGOs and councils<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p><strong>3. Legal Basis Under Maltese Law<\/strong><\/p>\n\n\n\n<p><strong>3.1. Constitution of Malta<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Article 42<\/strong>: Guarantees the freedom of association. Individuals and groups have the right to associate for any lawful purpose, including humanitarian work.<\/li>\n<\/ul>\n\n\n\n<p><strong>3.2. Voluntary Organisations Act (Cap. 492)<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Act <strong>only applies to organisations that handle money, assets, public funds, or seek legal personality<\/strong>.<\/li>\n\n\n\n<li>Doninu, which does <strong>not collect or handle money<\/strong>, is <strong>not required to register<\/strong> under Cap. 492.<\/li>\n\n\n\n<li>The Commissioner for Voluntary Organisations has <strong>no legal authority to regulate non-registered groups<\/strong> who operate legally and without financial activity.<\/li>\n<\/ul>\n\n\n\n<p><strong>3.3. Civil Code (Cap. 16)<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Recognises informal associations and private initiatives, including acts of charity and community solidarity that do not seek legal personality or engage in commercial activity.<\/li>\n<\/ul>\n\n\n\n<p><strong>3.4. Criminal Code (Cap. 9)<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Doninu&#8217;s activities are clearly lawful and are not prohibited by any criminal legislation. Its actions to report abuse or neglect to authorities are legally supported.<\/li>\n<\/ul>\n\n\n\n<p><strong>3.5. Data Protection and Safeguarding Laws<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Doninu ensures personal data and safeguarding issues are referred appropriately, in line with the <strong>Data Protection Act<\/strong> and child protection norms.<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p><strong>4. Legal Basis Under EU Law<\/strong><\/p>\n\n\n\n<p><strong>4.1. Protection from Overreach by Regulatory Authorities<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The CVO is legally <strong>restricted from interfering<\/strong> in the operation of groups like Doninu that do not manage or raise money.<\/li>\n\n\n\n<li>The CVO may <strong>collaborate<\/strong> with such groups but cannot impose registration or administrative burdens.<\/li>\n\n\n\n<li>Any attempt to restrict, threaten, or dissolve Doninu for not registering with the CVO would <strong>violate fundamental rights<\/strong> and could be challenged in Europe Authorities.<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p><strong>7. Equal Access to Non-Monetary Benefits<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Doninu is entitled to <strong>equal access to public infrastructure<\/strong>, like use of school halls or local council venues, as long as no money is involved.<\/li>\n\n\n\n<li>Denial of such access based solely on non-registration is discriminatory and may breach both <strong>Maltese constitutional principles<\/strong> and <strong>EU anti-discrimination laws<\/strong>.<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p><strong>8.
